Lawyer: Manziel could play before inquiry is done

The attorney for Johnny Manziel says even if the NCAA investigation of the Heisman Trophy winner isn't completed by the start of the season the quarterback should be able to play in Texas A&M's first game.

Jim Darnell, Manziel's El Paso, Texas-based attorney, says he has met with Manziel and his family, but provided few details about the status or nature of the investigation.

He did say he believed that Manziel would play Aug. 31 when the Aggies open the season against Rice, but could not put a timetable on the case.

"I don't know if it will be done before the season," Darnell told the AP on Friday night. "I believe the process should be far enough along that he'll be able to play.

"We have no control over how long the process will last."

ESPN has reported the NCAA is investigating Manziel for receiving payment for signing autographs, a violation of amateurism rules that could put his eligibility in question for the coming season.

Darnell would not confirm that Manziel is being investigated for profiting from autographs. He declined to say if Manziel has already met with the NCAA or if the 20-year old quarterback has plans to speak with investigators.

He did say Manziel intended to cooperate with the NCAA.

Manziel became the first freshman to win the Heisman last season, and he has remained in the spotlight throughout the offseason.

He caused a stir in July when he left the Manning Passing Academy in Louisiana a couple days early after, he says, he overslept and missed meetings and activities.

Texas A&M is coming off an 11-2 season and is expected to be ranked in the top 10 when this season starts. The Aggies face Sam Houston State in their second game of the season before hosting national champion Alabama on Sept. 14.

Apple's migration from Samsung boosts semiconductor business in 2013

As Apple shifts semiconductor manufacturing from arch legal rival Samsung to pure-play foundries, this will, according to a report by research firm IHS, "single-handedly boost the growth of the chip contract manufacturing market this year."

And it's not a small twitch of the needle either. According to the report, pure-play semiconductor foundry market revenue is set to grow by 21 percent compared to last year.

Compare this to the overall semiconductor industry, which is predicted to expand by a far more modest 5 percent, and you see

Pure-play foundry industries are already on track to hit these levels of growth this year, with revenue amounting to $8.2 billion in Q1 of this year, up 4 percent from $7.9 billion compared to Q4 last year.

"The growth outlook for the pure-play foundry business has risen considerably in anticipation of Apple?s transition of its applications processor chip manufacturing to third-party manufacturers," said Len Jelinek, director and chief analyst of semiconductor manufacturing at IHS.

"Previously, Apple had relied on Samsung as the primary supplier of applications processor chips for the iPhone and iPad. However, Samsung is not considered a pure-play foundry. Instead, it is designated as an integrated device manufacturer (IDM)?a chip supplier that not only builds products but also possesses design capabilities and sells devices under its own brand name, functions not performed by foundries."

"However, Apple?s anticipated shift is also the result of its well-publicized tiffs with Samsung over patent infringements on both makers? smartphones that have strained relationships between the two," Jelinek added.

Despite predictions of strong growth, IDC also highlights a number of concerns. At the top of this list is the world economy. If consumers get jittery, then they'll stop buying consumer electronics, and this could cause the good luck to fizzle out.

Another threat to the pure-play foundries could come from IDMs such as Samsung and Intel. As these firms revamp their manufacturing models and move to new and more efficient lithographies, incumbent pure-play foundries find themselves caught up in an arms race with companies that have deep pockets.

According to IHS definitions, pure-play foundries are those that exclusively perform contract manufacturing of chips for other semiconductor suppliers, and this includes companies such as Taiwan Semiconductor Manufacturing Co. Ltd (TSMC) and United Microelectronics Corp.

AP Source: MLB may suspend A-Rod under labor deal

NEW YORK (AP) ? Major League Baseball may try to suspend Alex Rodriguez under its collective bargaining agreement instead of its drug rules, which would eliminate any chance of delaying a penalty until after the case goes to an arbitrator, The Associated Press has learned.

Rodriguez has never been disciplined for a drug offense, and a first offender under baseball's Joint Drug Agreement is entitled to an automatic stay if the players' association files a grievance ? meaning the penalty is put on hold until after an arbitrator rules.

While use of banned performance-enhancing substances falls under the drug agreement, MLB may argue other alleged violations are punishable under the labor contract, a person familiar with management's deliberations told the AP, speaking on condition of anonymity because no statements were authorized.

Taking that action would prevent the New York Yankees third baseman from returning to the field, even if he recovers from a quadriceps injury cited by the team as the reason for keeping him on the disabled list.

And merely threatening to use that provision might give MLB leverage to force a deal.

The Yankees expect Rodriguez to be accused of recruiting other athletes for the clinic, of attempting to obstruct MLB's investigation, and of not being truthful with MLB in the past when he discussed his relationship with Dr. Anthony Galea, who pleaded guilty two years ago to a federal charge of bringing unapproved drugs into the United States from Canada.

Four years ago, Rodriguez admitted using PEDs while with Texas from 2001-03. He has repeatedly denied using them since.

Baseball has been investigating Rodriguez and other players since a January report in the Miami New Times alleging they received PEDs from Biogenesis of America, a closed anti-aging clinic on Florida.

"We're still involved in the process of preparing for an eventual appeal in this matter," Rodriguez's lawyer, David Cornwell, said Monday on ESPN New York Radio. "My understanding is that the next step that is going to be taken is that the players' association and baseball will meet to discuss the investigation and baseball's focus on particular players. So we'll see how that process plays out. But at this point my understanding or my expectation is that we're going to be working through the process towards an appeal."

Cornwell did not return an email seeking comment.

Aside from the drug agreement, there is no automatic stay for suspensions under baseball's labor contract. Rodriguez could be punished under Article XII B of the Basic Agreement, which states: "Players may be disciplined for just cause for conduct that is materially detrimental or materially prejudicial to the best interests of baseball including, but not limited to, engaging in conduct in violation of federal, state or local law."

If suspended under that section, Rodriguez would serve the penalty while a grievance is litigated before arbitrator Fredric Horowitz ? unless the union asks for a stay and the arbitrator grants one, which would be unusual under the grievance procedure. And baseball could always try to punish A-Rod on drug violations later.

It would be difficult for Selig to remove the arbitrator from the process. A provision in Article XI gives the commissioner permission to rule instead of the arbitrator on a complaint "involving the preservation of the integrity of, or the maintenance of public confidence in, the game of baseball."

But a letter from Selig that is Attachment 1 states: "I understand that the players' association has expressed concern that the commissioner might take some action pursuant to Article XI (A) (1) (b) of the Basic Agreement which could negate rights of players under the new Basic Agreement. While I have difficulty seeing that this is a real problem, I am quite willing to assure the association that the commissioner will take no such action."

Cornwell would not respond to a report in the New York Daily News on Monday that said baseball Commissioner Bud Selig would not pursue a lifetime ban if Rodriguez accepted a suspension through 2014.

"There's been all sorts of reports, all sorts of sources and all sorts of breaking news and breathless coverage, and I don't feel any need to respond to any of it," Cornwell told ESPN.

In announcing Ryan Braun's 65-game suspension last week, MLB cited violations of both the labor contract and drug agreement.

A person familiar with that deal, speaking on condition of anonymity because no statements were authorized, said 50 games of the penalty for the 2011 NL MVP were connected to Biogenesis. The additional 15 games stemmed from the Milwaukee outfielder's actions during the grievance that overturned his October 2011 positive test for testosterone.

Cornwell represented Braun in the 2012 hearing before arbitrator Shyam Das but said he was not involved in Braun's agreement to be suspended.

Rodriguez, who turned 38 Saturday, has not played this season following hip surgery in January. The three-time AL MVP, fifth on the career list with 647 home runs, appeared to be on the verge of rejoining New York on July 22, but the Yankees said a day earlier that an MRI revealed a strained quadriceps.

Rodriguez pushed to be activated last Friday, but the Yankees said he wouldn't even resume a minor league injury rehabilitation assignment until Aug. 1. Rodriguez then went on a New York radio station to criticize the team's decision.

The Miami New Times story was prompted by information provided by Porter Fischer, an ex-Biogenesis employee.

"What's been made public are various documents that a disgruntled ex-employee of Bogenesis allegedly stole. I would imagine we'll spend time talking with the arbitrators about the documents and things of that nature, their authenticity, their relevancy, the reliability," Cornwell told ESPN.

Gary Smith, a spokesman for Porter Fischer, responded in an email: "Cornwell can get in line with many others who want to attack Porter Fischer for exposing the truth and is left without support. He did it because it was the right thing to do."

Also Monday, Toronto manager John Gibbons said he thinks Blue Jays outfielder Melky Cabrera won't be penalized. Cabrera, MVP of the 2012 All-Star game, was banned for 50 games last year for a positive testosterone test while with San Francisco.

"We don't think anything's going to happen," Gibbons said. "We think, because he served his time, it's over with. I haven't given it much thought and the GM hasn't talked much about it."

Backpage.com has become the Craigslist of prostitution ads in recent years since that free site stopped running the ads in 2010.

Search for "Backpage.com" on the FBI's main website and up pops eight whole pages of press releases and public announcements naming the classified advertising site as a tool for sex criminals, particularly those selling children, sex and prostitution. And in fact, Backpage was named as one of the sources law enforcement used to help gather evidence needed to coordinate a 70-city raid last weekend that resulted in the rescue of 105 teenagers and the arrest of 159 pimps.

"The fact that they were able to rescue that many children and arrest that many pimps is fantastic," Liz McDougall, counsel for Backpage told NBC News Monday. "We are glad to be a partner with and support law enforcement to make these arrests, and make them in time to rescue these children."

A partner with law enforcement? While Backpage may be the current Craigslist for prostitution ads in the United States, McDougall says the site gladly cooperates with police when they want information about those who place the ads, including the IP, or Internet protocol, address from where the ads originated.

But a new effort by the National Association of Attorneys General wants to change federal law so that Internet service providers and websites like Backpage could be prosecuted by state and local governments for promoting prostitution and child sex trafficking, simply by running such ads.

It's a double-edged sword, some might say: Shutting down online ad venues for criminals and sexual traffickers seems like a good "nowhere to run" idea, but law enforcement looks to such sites to find information about the criminals they're chasing. And some argue that if you shut down one such "offending" site, another pops up anyway. Besides, there's a bigger issue at the heart of this: The same laws that protect the unsavory ads online also protect most Internet providers from liabilities of all kinds.

Backpage is specifically named in a letter from the attorneys' general group, sent last week to members of Congress, seeking an amendment to the Communications Decency Act of 1996:

Every day, children in the United States are sold for sex. In instance after instance, State and local authorities discover that the vehicles for advertising the victims of the child sex trade to the world are online classified ad services, such as Backpage.com. The involvement of these advertising companies is not incidental ? these companies have constructed their business models around income gained from participants in the sex trade.

Federal enforcement by itself has "proven insufficient to stem the growth of Internet-facilitated child trafficking," says the group, with the letter signed by 49 state and territorial attorneys general. "Those on the front lines of the battle against the sexual exploitation of children ? state and local law enforcement ? must be granted the authority to investigate and prosecute those who facilitate these horrible crimes."

It's an effort applauded by the National Center for Missing & Exploited Children, which works with law enforcement on sex trafficking cases.

"Classified-ad websites have made child sex trafficking an easy and profitable business enterprise for pimps," said John Ryan, the center's CEO, in a recent statement. "NCMEC urges all policymakers to explore every avenue available to bring to justice those who profit from the sexual exploitation of children."

Perhaps you're wondering why so many name Backpage and not Craigslist. In 2010, Craigslist, under pressure from more than a dozen individual states' attorney generals, voluntarily banned ads for adult services from the site. When that happened, much of the business moved to Backpage.com. (Village Voice Media, which owns the Village Voice, among other publications, also owned Backpage.com until last fall, when it became a separate company.)

Whether or not Backpage follows suit and ditches adult services, experts argue that the law itself should not be changed in order to make this happen.

Mark Rasch, former head of the Department of Justice's Computer Crimes Unit, and now an independent consultant, told NBC News he is against the proposed change, which would restrict free speech, now a key protection under Section 230 of the Communications Decency Act. He also says it's the "wrong way" to go after those in the child sex trade.

"Sex traffickers use the Internet to sell their wares, use the telephone lines to communicate with customers, use the banking and credit card system to obtain payment for sex services, use highways and local roads to transport minors for sex, use cars and other vehicles for the same purpose," he wrote in a recent blog post. "They use the same infrastructure established to sell toothpaste to sell illicit sex with minors. They need to be arrested and prosecuted for these crimes."

But third parties that might be accused of making those crimes possible ? whether it's ISPs or gas stations ? shouldn't be held criminally liable "for their own participation," he argues. An amendment to the law like this one means that "EBay could be held liable if someone purchased a knife online and then used that knife to kill someone, if a state passed a law making the advertisement of knives that are used for such purposes a crime."

Matthew Zimmerman, senior staff attorney for the Electronic Frontier Foundation, a digital civil liberties organization, told NBC News that with the "proliferation of user-generated speech online over the past decade," the proposed amendment would be "extraordinarily harmful."

The EFF successfully defended both Backpage and the non-profit Internet Archive in a suit against the state of Washington, which in 2012 passed a law that essentially made it a crime to "knowingly" publish or display any ad for a commercial sex act, including the depiction of a minor. The EFF said that the new state law considered both sites publishers, contrary to the provisions of the Communications Decency Act. A federal court agreed, and blocked the law.

Zimmerman says it's not only "lawful speech" that would be hurt by letting states prosecute service providers and websites. "This could also lead to the loss of critical tools that law enforcement could use to investigate these and other crimes," he told NBC News.

McDougall of Backpage agrees. The arrests over the weekend are "something that wouldn't be possible if you didn't have a domestic, cooperative website involved," she said. "That's why it's important to not drive this content to offshore websites, which won't cooperate and don't have to cooperate with U.S. law enforcement. It would make law enforcement's job exponentially more difficult."

Still, there are many who'd argue that giving child traffickers one less avenue would be a win for the good guys. It's not known yet what, if any, action Congress will take on changing the Communications Decency Act. The issue is sure to be debated in the months to come.

Volkswagen Golf Cross Polo equipped with makeshift guns used in assassination attempt [video]

Czech businessman Radovan Krejcir has miraculously survived a bizarre assassination attempt in Johannesburg, South Africa.

As Krejcir was walking into his office, he heard a serious of explosions which he assumed were fireworks. In reality, they were a series of gun shots which were being fired from the rear end of a Volkswagen Cross Polo that was parked perpendicular to him.

Thankfully Krejcir was uninjured as his armored Mercedes took the brunt of the attack. Authorities are still investigating but it appears the Cross Polo was able to get off about 10 shots before it caught on fire.

Krejcir says he doesn't know who would want to kill him but the AP is reporting he is a fugitive who was convicted of tax fraud and has connections to "underworld figures" in Johannesburg.

Cambridge Nonprofit Moving to Medford - Business - Medford, MA ...

See who?s coming to the city.

Management Sciences for Health, a nonprofit that helps developing countries establish healthcare systems, is moving from Cambridge to 200 Rivers Edge Drive in Medford, Mayor Michael McGlynn announced at the site Tuesday.

The nonprofit will occupy the vacant 40,000-square-foot space remaining in the building, he said.

McGlynn said now that the 115,000-square-foot building is full, developer John Preotle, of Preotle, Lane & Associates, has discussed constructing another building at the site.

State Rep. Paul Donato said the overall site is in its ?embryotic stages? at the press conference.

Greg Bialecki, the state?s secretary of Housing and Economic Development, said the move is good for the state.

?We have to make sure that people don?t only think Boston and Cambridge are where all the great innovation businesses are,? he said.

Norfolk woman to help kids in Africa

A Norfolk woman spent the last few years helping children whose parents are behind bars. Now, she's taking her efforts across the globe to Africa.

Carolyn LeCroy created "The Messages Project" in the 1990's. Her organization goes into prisons and
records messages of parents reading books or saying something special to their children. Then LeCroy's group takes those messages to the children so they still feel connected to their parents.

"The messages are messages of love, messages of hope, messages to let the children now it's not their fault," LeCroy said. "One of the things we know is that to help reduce recidivisms, a strong strong family bond is necessary."

The Messages Project has spread to several different states, and was honored by CNN in 2008. LeCroy leaves Saturday to take the project to Africa. For more details go to LeCroy's website.

Options action suggests Apple earnings will not roil its shares

NEW YORK/CHICAGO (Reuters) - Apple Inc is not expected to show a big post-earnings swing when it reports fiscal third-quarter results after the closing bell on Tuesday, but this could also mean investors are under-hedged in case the company delivers a shock.

The options market is pricing in a potential move up or down of 4 to near 5 percent in Apple's stock price following the results. This is in line with a historic average move of about 4.3 to 4.4 percent over the past four quarters.

"Even though the implied move is relatively in line with historical movements, it is our belief that implied volatility is too high ahead of the announcement and that the stock will move less than expected," said Andrew Keene, president and founder of options trading firm KeeneOnTheMarket.com in Chicago.

Implied volatility measures the perceived risk of future stock movements conveyed by option prices.

"Google and Netflix both massively undershot their implied moves on earnings and we will be trading Apple expecting the same," Keene said.

Apple shares were down 0.8 percent at $422.82 on the Nasdaq early on Tuesday afternoon.

The stock's post-earnings moves have been all over the map in the last year: down 4.3 percent the day after earnings came out in July 2012, down 1 percent in October 2012, a 12 percent drop in January 2013, and no move in April.

"Normally what happens into an earnings event is that implied volatility will run higher as traders and investors look to protect themselves against any large moves in the stock. We did not see that this quarter," said Steve Place, founder of options analytics firm investingwithoptions.com in Austin, Texas.

The iPhone and iPad maker is expected to post a smaller quarterly profit and its financial report may come under intense scrutiny. Revenue is expected to come in flat, while earnings per share is expected to fall by 21 percent, according to Thomson Reuters data.

The implied volatility for the next 30 days for Apple stands at 29.4 percent, according to options analytics firm Livevol. That number compared with the same measure from the past seven earnings cycles is very low, said Ophir Gottlieb, managing director of Livevol Inc.

"This tells us that investors are not expecting large movements and they would be under-hedged if Apple earnings deviated significantly from what is expected," Place said.

Because of this, investors using short-term volatility strategies such as selling options to capture premium going into earnings are exposed to the risk of a larger-than-expected move in the stock compared with previous quarters, Place said.

"If history repeats, it suggests an options bet on a 4 percent move could prove disastrous from either the long or short volatility side," said Adam Warner, contributor at Schaeffer's Investment Research in Cincinnati, Ohio.

Once the most valuable company in the world, Apple's stock price has hovered between $400 and $450 for months, after dropping from record high around $705 in September 2012. The stock has lost nearly 20 percent of its value this year.

The intrinsic value of Apple is estimated at $728, way above the current share price, according to Thomson Reuters' Starmine.
